Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Spotter mobile application ("the App") provided by Spotter ("we", "us", or "our"). By downloading or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years of age to use the App. By using the App, you represent that you meet this requirement. If you are under 18, you must have the consent of a parent or legal guardian.

2. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

• Provide accurate and complete information during registration.
• Keep your password secure and not share it with others.
• Notify us immediately of any unauthorised use of your account.

We reserve the right to suspend or terminate accounts that violate these Terms.

3. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable law.
• Attempt to gain unauthorised access to our systems or other users' accounts.
• Reverse-engineer, decompile, or disassemble any part of the App.
• Use automated scripts or bots to interact with the App.
• Transmit any malicious code, viruses, or harmful data.

4. User Content

You retain ownership of all content you create in the App (training programs, custom exercises, workout logs). By using the App, you grant us a limited, non-exclusive licence to store and process this content solely to provide the App's services to you.

We do not claim any intellectual property rights over your personal fitness data.

5. Health and Fitness Disclaimer

The App is not a medical device and does not provide medical advice. The information and features in the App are for general fitness and informational purposes only. You should consult a qualified healthcare professional before starting any new exercise programme, especially if you have a pre-existing medical condition or injury.

We are not responsible for any injury, illness, or adverse health outcome resulting from the use of training programmes or exercise data in the App.

6. Intellectual Property

The App, its design, code, and the global exercise library (exercises not created by you) are the intellectual property of Spotter and are protected by applicable copyright and trademark laws. You may not reproduce, distribute, or create derivative works without our prior written consent.

7. Limitation of Liability

To the fullest extent permitted by applicable law, Spotter shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or personal injury, arising out of or in connection with your use of the App.

Our total liability to you for any claim arising under these Terms shall not exceed the amount you paid us in the twelve months preceding the claim (or €10 if no payments were made).

8. Availability and Changes to the App

We reserve the right to modify, suspend, or discontinue the App (or any part of it) at any time, with or without notice. We are not liable to you or any third party for any such modification, suspension, or discontinuation.

9. Termination

You may stop using the App and delete your account at any time from Settings → Delete Account. We may terminate or suspend your access immediately, without notice, if you breach these Terms. Upon termination, all provisions that by their nature should survive will continue to apply, including intellectual property provisions and limitation of liability.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of Italy, without regard to conflict of law principles. Any dispute arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Italy.

11. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date. Your continued use of the App after any changes constitutes your acceptance of the revised Terms.
